Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Trapound Go mobile application and related services (the "Service").

These Terms form a legal agreement between you and Trapound ("Trapound Go," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction, or otherwise have permission from a parent or legal guardian where allowed by law, to use the Service.

2. The Service

Trapound Go is a mobile risk-calculation and trade-planning tool designed to help users estimate position sizing and related win/loss projection scenarios for futures and forex trading.

Trapound Go is provided for informational and educational purposes only.

It is not a brokerage service, order-entry system, investment adviser, financial planner, tax adviser, or legal adviser.

3. No Financial, Investment, Tax, or Legal Advice

Trapound Go does not provide investment advice, financial advice, tax advice, legal advice, or recommendations to buy, sell, hold, or enter any trade.

Any calculations, projections, examples, or outputs provided by the Service are estimates only and may be based on user-entered information.

Market conditions, slippage, commissions, spreads, fees, platform rules, product specifications, broker settings, execution quality, and other factors may cause actual outcomes to differ materially.

You are solely responsible for evaluating whether any trade, risk level, or strategy is appropriate for you.

4. No Guarantee of Results

We do not guarantee:

• profitability
• trading performance
• capital preservation
• accuracy of user-entered values
• uninterrupted access to the Service
• that any projection or estimate will match actual trading results

Past performance and hypothetical scenarios are not guarantees of future results.

5. User Responsibilities

You agree that you are solely responsible for:

• the accuracy of the information you enter
• reviewing all calculations before relying on them
• understanding the contract specifications, pip values, tick values, spreads, commissions, fees, and margin rules relevant to your broker or market
• complying with all laws, regulations, and platform rules applicable to your trading activity
• your own trading decisions and financial outcomes

6. Subscriptions, Billing, and Renewals

If Trapound Go is offered as a paid subscription or in-app purchase, billing will be handled by the applicable app store or platform provider, such as Apple or Google.

Unless otherwise stated by the applicable store, subscriptions may automatically renew until canceled.

You are responsible for managing, changing, or canceling your subscription through your app store account settings.

Except where required by law, refunds, credits, billing disputes, and payment processing matters are governed by the applicable app store's terms and policies.

7. License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Trapound Go for your personal, lawful, and internal use.

You may not:

• copy, reproduce, distribute, or publicly display the Service except as permitted by law
• modify, adapt, translate, or create derivative works of the Service
• reverse engineer, decompile, or attempt to extract source code except where prohibited from restricting that right by law
• interfere with or disrupt the operation or security of the Service
• use the Service for unlawful, fraudulent, or abusive purposes
• remove copyright, trademark, or other proprietary notices

8. Intellectual Property

The Service, including its design, text, graphics, branding, software, calculations, features, content, and underlying technology, is owned by or licensed to Trapound and is protected by intellectual property and other laws.

"Trapound," "Trapound Go," related logos, and associated branding are our property unless otherwise stated.

9. Third-Party Platforms and Services

The Service may depend on or interact with third-party platforms or services, including app stores, analytics providers, crash-reporting tools, hosting providers, or payment systems.

We are not responsible for third-party services, and your use of them may be governed by their separate terms and privacy policies.

10. Service Availability and Changes

We may modify, suspend, discontinue, or restrict all or part of the Service at any time, with or without notice, to the extent permitted by law.

We are not liable for any unavailability, interruption, delay, or loss of functionality.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, SECURE, ERROR-FREE, OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Trapound AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
• FIFTY U.S. DOLLARS (US $50)

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

13. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Trapound and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the Service
• your violation of these Terms
• your violation of any law, rule, or regulation
• your trading activity or decisions

14. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, created risk or possible legal exposure for us, or where otherwise permitted by law.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, dispute provisions, and other similar terms.

15. Governing Law

These Terms are governed by the laws of Georgia/United States without regard to conflict-of-law principles, except where applicable law requires otherwise.

16. Disputes

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Georgia/United States, and you consent to their jurisdiction and venue, except where applicable law requires otherwise.

If you want, you may instead choose to include arbitration language here after review with counsel.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective Date" above and may provide additional notice where appropriate.

Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
